Terms of Service
The terms that govern your use of the Digilayers website. Please read them before you continue.
Last updated: May 31, 2026These are the ground rules for using this site and working with us, written plainly here with the formal version set out below.
01Acceptance of these terms
These Terms of Service govern your use of the Digilayers website. By accessing or using the site, you agree to these terms. If you do not agree, please do not use the site.
02Who we are
Digilayers is a digital marketing agency based at 901 Guelph Line, Burlington, ON L7R 3N8, Canada, working with clients across North America, the United Kingdom, and the Middle East. aiLayers is our sub-brand for the AI infrastructure that supports our work. References to “we”, “us”, and “our” in these terms mean Digilayers.
03Use of the site
When you use this site, you agree to:
- Use it only for lawful purposes and in line with these terms.
- Provide accurate information when you contact us through a form.
- Refrain from interfering with the operation, security, or availability of the site.
- Refrain from attempting to gain unauthorized access to any part of the site or its systems.
04Services and proposals
This website describes the services Digilayers offers. Information on the site is for general guidance and does not, on its own, create a binding agreement to provide services. Any engagement is set out in a separate written proposal or agreement, which governs the scope, deliverables, timing, and fees for that work. Where a separate agreement conflicts with these terms, the separate agreement governs that engagement.
05Intellectual property
All content on this site — including text, graphics, logos, the Digilayers and aiLayers marks, layouts, and code — is owned by Digilayers or used under licence, and is protected by intellectual property laws. You may view and share links to the site, but you may not copy, reproduce, distribute, or create derivative works from its content without our prior written permission.
06Content you submit
When you send us information through a form or other channel, you confirm that you are entitled to share it and that it is accurate. You grant Digilayers permission to use that information to respond to you and to provide the services you ask about. You keep ownership of the content you submit.
07Third-party links and tools
The site may link to or embed third-party websites, content, or tools that we do not control. We provide these for convenience and are not responsible for the content, practices, or policies of those third parties. Your use of them is governed by their own terms.
08Disclaimers
The site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties of any kind, express or implied, about the site, including its accuracy, reliability, or availability. We do not warrant that the site will be uninterrupted, secure, or error-free.
09Limitation of liability
To the fullest extent permitted by law, Digilayers and the people who work with us will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of — or inability to use — this site. Nothing in these terms limits liability that cannot be limited under applicable law.
10Indemnity
You agree to indemnify and hold Digilayers harmless from claims, losses, and reasonable expenses arising out of your misuse of the site or your breach of these terms, to the extent permitted by law.
11Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law principles. The courts located in Ontario, Canada will have jurisdiction over any dispute relating to these terms or the site, subject to any rights you have under the law of your own country.
12Changes to these terms
We may update these terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the site after changes are posted means you accept the updated terms.
